The 32 year old father of Lekutu, Bua, who allegedly murdered his 14 month old baby, today appeared in court with his counsel seeking the withdrawal of the charges against him.
Ratu Beni Baleimualevu appeared before Magistrate Eparama Rokoika, who was informed by the defense counsel, that the charges against him would be withdrawn, as he was not in a sound mind when he committed the crime.
However, Magistrate Rokoika said that in the absence of a formal notification from the DPP's office, the matter could not proceed.
The court was informed that Baleimualevu, who has been undergoing psychiatric evaluation at the St Giles Hospital, had made significant recovery.
The matter has been adjourned till tomorrow morning with the DPP's office told to produce formal notification on whether charges would be withdrawn.
