Terminated GCC members to mount legal battle
Lawyer representing Ratu Ovini Bokini and others, Savenaca Komaisavai has confirmed to Village news that such an appointment is illegal and they will fight the interim government all the way.
He adds Commodore Bainimarama should not have taken such an action as it has brought disrespect to the Fijian people.
Meanwhile, the state has called on the High court to merge the two other cases brought against the interim government by the terminated members of the GCC.
When the case was called this morning, Adish Narayan told Judge Justice Jiten Singh that there are two cases by the same party currently before the courts, one is a constitutional redress for the termination of the GCC members and the other is a judicial review against the President for the promulgation of the GCC regulations. He said both cases indirectly deal with the same issue and must be dealt with by a single judge as a single case.
However, representing Ratu Bokini and others, Kitione Vuataki objected saying the cases deal with different matters and must be dealt with separately.
Judge Singh will deliver his ruling on the submissions to merge all the cases on March 6th.
