Teleni to comment on judge’s ruling
When contacted this morning, Commodore Teleni said he will respond to the Judge's ruling.
Justice Winter has cited this issue while dealing with an application made by Navy Commander, Francis Kean for Judge Winter to disqualify himself from presiding over Kean's murder trial.
In his ruling yesterday, Justice Winter said there was no evidence as to how the accused, Francis Kean came into possession with a confidential letter written by Commodore Teleni to the Permanent Secretary of Justice.
Judge Winter has referred his judgment to the DPP by way of a report of suspected breach of section 131 or 136 of the Penal Code, in that the document was leaked to the defense counsel and has also asked the Attorney General to look into the matter.
Kean had made the application to change the judge for his case based on alleged biased decisions by Justice Winter.
While, rejecting Kean's application yesterday, Justice Winter said that the accused will be treated equally regardless of his background. The trial continues today at 10am.
Francis Kean has been charged with the murder of a salesman John Whippy outside the Suva Yatch club on December 31st last year.
