A Tavua man who appealed against his 18month sentence for pleading guilty to the charges of larceny appeared before Lautoka High Court, Justice Anthony Sherry today.

Saimoni Navara and others in July, 2007 at Drauniivi, Tavua stole 1,187 litres fo Diesel valued at $1,733, the property of Fiji Pine Limited.

The court heard, that when the Plantation Coordinator went to fill up his vehicle, he discovered that 1,187 litres of diesel was missing from the storage tank which belongs to Fiji Pine, it was realised that the missing diesel had not been recorded in the internal fuel register.

Today Judge Sherry told the court that the learned Magistrate should have given a discount of a third rather than one tenth for the Appellant's guilty plea.

Judge Sherry concluded the appeal is allowed and quashed the previous 18 month sentence to eight months imprisonment, starting from the 15th Sept last year.
