Several attempts were made by the mother and grandparents of the eight year old boy whose body was discovered in the bushes in Vunaniu, Serua yesterday, to try to locate the child after his disappearance earlier this year.
Fijivillage News has received confirmation that the eight year who was in the custody of the grandparents was released to the father in early July.
This was based on an arrangement three years ago when the boy's parents separated.
The father was only given access to the child every third weekend.
However the 46 year old father who is now in custody for allegedly murdering and burying his son in the bushes in Serua, failed to return the son to the grandparents after the July visit.
The man and the son could not be found anywhere by the boy's grandparents.
The lawyer for the eight year old boy's mother and grandparents,
Sushil Chand Sharma said they then tried to secure a court order to locate the child and get him back in their care.
He said although the new court order stated that police should assist in the execution of the order, nothing eventuated.
Fijivillage News has today received court ruling documents from the Family Division of the Magistrates Court in Suva which states that the eight year old boy's father should immediately return the child to the mother and the grandparents.
The order by Magistrate Tomasi Bainivalu dated on the 29th of July this year also stated that the police should assist in executing the court order.
Magistrate Bainivalu had also ruled that the child's contact to the father be temporarily suspended until the contempt proceedings is heard and determined by the court.
Sushil Chand Sharma, the lawyer for the eight year old boy's mother and grandparents, said they kept trying from July this year to locate the father and the young boy.
Despite the court order in their favour, no one came to their aid.
He said no one even bothered to conduct the search and he and the grandparents were told that when the child is located then they will take some action.
Yesterday Police Deputy Director Operations, Erami Raibe revealed to Fijivillage News that the eight year old boy's father was found hiding in the bushes by some villagers of Vunaniu and they are questioning him to try and establish where he buried his son's body.
According to SP Raibe the 46 year old confessed to police about the incident.
We spoke to SP Raibe in the last hour and he confirms that the 46 year old man is still being interrogated by the police and the post mortem of his eight year old son is currently underway.
Fijivillage News also asked SP Raibe on whether police during their course of investigations will also investigate the police officers who were approached by the eight year old boy's family.
It has been confirmed that the mother of the eight year old boy was studying in New Zealand, and that was the main reason why custody was granted to the young boy's grandparents.
The boy's grandparents still cannot come to terms with what has happened. His mother is expected back in the country soon.

Police have managed to recover the remains of an 8 year old boy who was allegedly killed and buried by his 46 year old father in Serua two months ago.
Navua Police have confirmed that the man took them to the place where he allegedly buried the son and officers recovered clothes and the remains of the boy.
Detectives are still guarding the scene.
Police are still waiting for a pathologist from Suva to examine the remains before it is removed from the bush.
The man is still under interrogation at the Navua Police station.
He was found hiding in the bushes by some villagers of Vunaniu and upon questioning him, the man confessed that he killed and buried his son.
The man and his wife were separated and he was paying maintenance.
Meanwhile, a team of police officers are now in Beqa to investigate the alleged murder of a 3 year old girl whose body was found floating in the Beqa waters on Saturday.
The post mortem report of a 3 year old girl revealed that she died from choking and police are now treating the case as murder.

Police are now combing the bush lands near Korovisilou in Serua to try and recover the body of an 8 year old boy who was allegedly murdered by his 46 year old father in June and buried in the bushes.

Meanwhile, a team of police officers are now on Beqa to investigate the alleged murder of a 3 year old girl whose body was found floating in the Beqa waters.
SP Raibe said the post mortem report of a 3 year old girl reveals that she died of choking and they are now treating the case as murder.
It was earlier believed that the girl had drowned however the report says that she may have been strangled.
SP Raibe said their team on Beqa is questioning a number of people but no one has been taken into custody at this stage.
