The Fiji Independent Legal Services Commission has found Suva lawyer Hamendra Nagin guilty of two separate charges of unsatisfactory professional conduct and has dismissed two other charges laid against him by the Chief Registrar.
Nagin also admitted one charge of unsatisfactory professional conduct.
The two counts on which Nagin has been found guilty relate to an incident in November 2004 where he advised his clients to increase the price of a residential property from $350,000 to $400,000.
Commissioner John Connors states in his ruling that he found the complainant to be a person who has had a most unsatisfactory result in what should have been a relatively simple land transfer.
On the above incident, Nagin also admitted to a charge of unprofessional conduct for creating a conflict of interest in the manner in which the land sale was handled by him between the owner and the purchaser.
Commissioner Connors also found Nagin guilty on the third complaint on the same charge which relates to Nagin failing to protect the interest of the property buyer during the course of the transaction.
Commissioner Connors dismissed a charge against Nagin where he was alleged to have charged excessive fees to a client and that he had allegedly failed to declare his conflict of interest which arose from Nagin representing the client in a matter regarding an Estate.
Three other separate complaints lodged against Nagin were withdrawn by the Chief Registrar and was dismissed by Commissioner Connors.
Commissioner Connors is now deliberating on penalties to be imposed against Nagin and will hand down his final decision on June 16th.
