The High Court has denied the application to strike out the writ of Herbeas Corpus filed by the Interim Attorney General in the Evan Hannah case.

Fiji Times Lawyer Jon Apted said the application filed last week by the Interim Attorney General, on behalf of the respondents - Immigration Director Viliame Naupoto and Permanent Secretary Immigration Malakai Tadulala - to strike out the writ of Herbeas Corpus was denied by the Courts.

Apted confirmed, Judge Justice Filimoni Jitoko is now listening to arguments on whether or not the court order was given to Immigration Officials before Hannah's deportation two Friday's ago.

Thus, Apted said, the next issue currently being argued in court is whether adequate service of the writ had been affected on the respondents.

Hannah was deported two weeks ago for supposedly breaching his work permit.

The case continues tomorrow afternoon at 2.30.
