Steps are now being taken to stop the auction of the multimillion dollar Momi Bay Resort project which is scheduled to go under the hammer on August 25th.

An application has been made in the High Court for a stay motion on the auction and lawyer representing one of the developers of the site Matapo Limited, Kafoa Muaror confirmed to Fijivillage that the issue of stay will be discussed with the judge when the case is called on Monday in the Suva High Court.

Muaror said there are also several other matters pending before the courts regarding the Momi project and they hope to address these issues in open court.

It has also been confirmed that a landowning unit in Momi, the Tokatoka Nasau has a case pending in court after they took legal action to try and claim compensation for the use of their land claiming that the negotiations for the land deal was not done in good faith.

A representative of the tokataka Nasau told Fijivillage that they have instructed their lawyer to apply for a stay on the auction until their case is settled.

However, lawyer representing the Tokatoka Nasau Rabo Matabalavu when contacted said the matter is before the court and he will not comment on any issue regarding the Momi Bay project.

The Fiji National Provident Fund took possession of the Momi site and announced it will be auctioned to the highest bidder in efforts to recover the over $80million investment in the project.

It was announced earlier that investors from around the world are interested in purchasing the resort project and several investors have brought teams down to carry out the due diligence process over the last few weeks.

FNPF is not aware of the application for a stay on the auction at this stage.
