An order by the Supreme Court of New South Wales which would have seen Air Fiji Limited pay around one million Fiji dollars has been set aside until their appeal is dealt with.

Australian company, Hawker Pacific obtained a default judgment against Air Fiji, which was then registered in Fiji under the Foreign Judgments Reciprocal Enforcement Act, however Air Fiji then applied for the judgment to be set aside and stayed pending the final determination of their case.

Air Fiji then applied for an extension of the stay as they dispute the amount of AU$766,020 and stated that if the stay is not granted, Air Fiji will be wound up because of the large sum involved, which is close to one million Fiji dollars.

Judge Justice Sosefo Inoke, after considering all the circumstances of the case has stayed the Fiji Judgment in the matter and given Air Fiji time to file an appeal against the ruling.
