State appeals Draunidalo case
Christopher Pryde revealed that they seek to take the matter to the Fiji Court of Appeal on eight grounds, which include that the Judge erred in making conclusions that the move was irresponsible as his comments are based on allegations.
He told Judge Coventry that he had also erred in assuming that the Interim AG had brought the case due to an ulterior motive as this is also based on speculation. The state also challenges the indemnity cost set by Justice Coventry at $20,000 and asked the court to issue an injunction to cease the payment, until the appeals process is over.
Draunidalo's lawyer Richard Naidu told the Judge to seriously consider the lack of explanations provided on bringing the case and then withdrawing it. He said the case, according to the Interim AG, was brought in the matter of public interest and withdrawn in the matter of public interest is a use and abuse of the issue.
Justice Coventry will make his ruling on whether the Appeal will be allowed on December 7th.
