The Commissioner of the Magistrates Court Inquiry John Connors is now in the process of finalizing his report to submit to President Ratu Josefa Iloilo after Nadi Magistrate Syed Mukhar again failed to appear before him this morning.
In a statement this afternoon, Connors said he noted that there was no appearance by or on behalf of Shah despite being given a number of chances to appear before him including the last occasion when he was to appear before him at 10am today.
Connors said with no appearance, it was apparent that Shah did not wish to make any submissions and he would now proceed to finalize his report.
However, speaking to FijiVillage, Shah's lawyer Kevueli Tunidau said they had made it clear that they would not appear before Commissioner Connors as they do not believe that he is impartial.
Tunidau added that his client was prepared to be questioned by police if Connors referred the matter to them and that his client believes they have reasonable cause to disobey a summons to appear for the inquiry.
Shah was summoned to appear before Connors after serious allegations were leveled against him during public submissions on the Inquiry into the Magistrates Court.
