The Police is obliged to investigate all complaints lodged with them under the law and the constitution of this country.
This is one of the arguments put forward by Lawyer representing the SDL party in their application for a Judicial review of Police Commissioner Commodore Esala Teleni's decision not to investigate their treason complaint against interim Prime Minister Commodore Frank Bainimarama and the RFMF.
Lawyer representing former Prime Minister Laisenia Qarase and others Aseri Vakaloloma appeared in Judge Justice Davendra Pathik's chamber to seek leave for the judicial review, they have stressed that the Commissioner and the Police are duty bound to investigate all complaint and cannot make public statements to say they will not investigate a particular case.
The SDL party had lodged the treason complaint and wanted the police to investigate Bainimarama, Teleni and members of the RFMF however, Commodore Teleni had stated that no investigation will be carried out.
The SDL wants the high court to overturn this decision and to rule whether the Head of the POlice force has the powers to deny investigating a complaint lodge with the police.
The case is adjourned till April 20th for hearing on the application.
