The Fiji Court of Appeal hearing in the Laisenia Qarase vs Commodore Frank Bainimarama case is set to get underway on Monday.

Four days have been set aside for the hearing of the appeal and this morning the Solicitor General Christopher Pryde confirmed that the three contentious matters on which both parties have agreed up include the existence of the prerogative powers vested upon the President, whether such powers can be reviewed by a court of law and if the events leading up to December 5th, 2006 could have compelled the President to exercise such prerogative powers.

Earlier today, the Citizens Constitutional Forum was granted permission to act as an intervener in the Qarase vs Bainimarama appeal case after a last minute application this morning by the CCF.

Pryde strongly objected to the application saying it was mischievous and an attempt to disrupt the proceedings, as the application is made at the eleventh hour, just less than a week for the appeal proper to get underway.

The Appeals judges questioned CCF Counsel Tupou Draunidalo on why they did not intervene or did not seek to intervene in the lower court. Draunidalo responded due to financial constraints they were not able to make the application in the high court adding CCF has now secured the funding to be able to make this application.

Meanwhile, the Appeals Judges told the Fiji Human Rights Commission that they were not acting as a Friend to the court as they refused to forward electronic copies of their submissions to the other parties and they have been order to do so by this afternoon.
