The retrial of the Qaranivalu, Ratu Inoke Takiveikata's mutiny case will not go ahead until the appeal filed in the Supreme Court by the Director of Public Prosecutions and the Acting Chief Justice Anthony Gates is dealt with.

Court officials today confirmed that the appeal against the Fiji Court of Appeal's decision which ordered a retrial for Ratu Inoke's case has already been filed in the Supreme Court.

However, the Supreme Court registry confirms that no date has been set as yet to hear the appeal as the Supreme Court currently does not have any judges.

The Judicial Services Commission is currently seeking qualified judges from abroad to act as judges to the Supreme Court, however, there is no set timeframe on when this will be achieved.

The Fiji Court of Appeal ordered a retrial for Ratu Inoke who was sentenced to life imprisonment in 2004 for allegedly inciting the November 2000 mutiny. However, Justice Gates, who was cited by the Appeals Court as having a bias approach to the case for comments he made at a cocktail party, has appealed against the decision.

The DPP has also filed a separate appeal.
