Private prosecution can take place if a citizen makes a complaint with police and the police fail or refuse to investigate the complaint.
Those were the sentiments of Fiji Law Society President Isireli Fa on private prosecution and after the SDL Party said it would take this step in the event that police refuse to investigate their treason complaint against the interim Prime Minister and others.
Fa added if the complaint is lodged and the matter is taken to court, the DPP had the powers to either proceed with the case or terminate it depending on evidence provided.
Police Commissioner Commodore Esala Teleni had earlier stated that the police will not conduct an investigation into the treason allegations as there is a civil case between Qarase and Bainimarama in the High Court.
