Former Fiji Labour Party parliamentarian Naresh Kumar will not been permitted to claim compensation for his vehicle which was burnt during the upheavals of May 19th, 2000.

As the compensation case filed by former Prime Minister Mahendra Chaudhry and others against the RFMF was call in High Court, Judge Justice Gerad Winter ruled that the amendment to the claim can not be granted.

Justice Winter highlighted that the matter regarding the damage sustained to Kumar's vehicle was not included in the original claims and time limitation on seeking such additions has lapsed.

After Kumar's lawyer Jattan Mishra stressed that it was an error on their part and the matter be included under the prerogative of the courts, Justice Winter said it is not an error but a new course of action and can not be accepted.

Meanwhile, a new Judge will now be assigned the case after Judge Winter referred the files back to the Master of the High Court J. Udit to conduct pre trial conferences and allocate the another judge.
