The Nasinu Town Clerk has issued a letter to Lawyer Rajendra Chaudhry to halt all court proceedings he has taken on behalf of the council against the Fiji Independent Commission Against Corruption.
The Town Clerk issued the letter to Chaudhry who has challenged the legality of FICAC in the case against Mayor Rajeshwar Kumar and Deputy Mayor Diren Sardar who are charged with alleged abuse of Office and embezzlement.
However Chaudhry said the decision to challenge FICAC's legality was made by after a resolution by the Nasinu town council and he will not stop the proceedings.
Earlier today suspended Nasinu Mayor Rajeshwar Kumar applied for leave to seek the court's permission to appeal the Interim Local Government Minister's decision to suspend him.
Kumar's lawyer Rajendra Chaudhry said Kumar still remains in his mayoral position and they are now waiting for the high court to decide on the matter.
Kumar was suspended by the Interim Minister for Local Government yesterday morning pending the outcome of his court case.
Councillor Kumar has been charged with two counts of alleged abuse of office and embezzlement by FICAC and was released on bail by the Suva Magistrates Court on $2000 bail last Friday.
