Naco admits overdrawing from trust account
Naco's lawyer Filimoni Vosarogo informed Commissioner John Connors that his client admits the charge laid against him and in mitigation he stressed that Naco has a clean record of maintaining the Trust Account.
Vosarogo said his client is remorseful for what had occurred and explained that Naco also kept the law firm's money in the trust account which resulted in the oversight on his part.
He urged the Commissioner to consider the fact that it was not his client's funds that he overdrew and requested that the Commission take a lenient approach to any reprimand and that a private reprimand and penalty would be suitable given that his client has admitted the charge.
Vosarogo also made submissions for the Commission to consider in relation to other complaints lodged against Naco highlighting that his client had carried out his work ethically and never breached the trust of his clients as alleged.
Meanwhile, after looking at the evidence presented before him in relation to another complaint of alleged misconduct and unprofessional behaviour, Commissioner Connors dismissed the charge against Naco.
Commissioner Connors will deliver his ruling in the complaints filed against Naco on June 11th.
