Acting National Manager Boarder Control at the Customs Department Tej Ram did not clarify in the High court today who from the top management gave the directive to impose the US$24 per carton export duty imposed on Natural Waters of Viti Limited products during their meeting in January this year.

Fiji Water Lawyer David Gooddard questioned Ram if he can tell the court whether the directive was from the Minister, however, Ram said he did not know because it comes from the Minister or Chief Executive officer.

Acting General Manager Customs and excise duty Jalal Dean also defended the company's decision to impose the duty while giving his evidence, stating their responsibility is to make sure that the export value comes back to Fiji.

The case has been adjourned to next week.
