The application to strike out the proceedings brought against the state by suspended Chief Justice Daniel Fatiaki is expected to be set for hearing in early May.

Both counsels met behind closed doors before Judge Justice Davendra Pathik this morning and agreed that they would be prepared for the hearing on the strike out application and they will meet again in chambers on May 5th to set a hearing date.

Justice Fatiaki filed legal action challenging his removal from office in January 2007 and appointments made to the Judiciary by the Judicial Services Commission and the Interim Attorney General since December 5th 2006.

The suspended Chief Justice also has a separate case before the courts challenging the validity of the three member tribunal which was appointed by the President to conduct an independent inquiry against him.
