Man found not guilty of attempted murder on grounds of insanity
The assessors in the trial found former Kundan Singh Supermarket Security guard Saubalavu Salaiwai not guilty of attempted murder on the basis on insanity but found him guilty on the second count of common assault.
However High Court Judge Justice Daniel Gounder ruled that the assessors opinions are inconsistent and against the weight of compelling psychiatric evidence adduced in the court.
Judge Gounder than ruled that Salaiwai is not guilty on both counts by reason of insanity.
Salaiwai was working as a security guard at Kundan Singh supermarket and the victim, Navneet Prasad was a co-worker.
On March 24th 2009, Salaiwai approached Prasad and told him not to talk to a cashier claiming the cashier was his wife, when infact she was not.
Judge Gounder noted that Salaiwai than went to the back of the supermarket and came back with a knife and stabbed the victim on the right shoulder who then fell to the ground.
While Prasad was lying on the ground, Salaiwai tried to stab him again before he fled the scene.
Judge Gounder ordered that Salaiwai be held in custody at the Saint Giles Hospital until such time the President orders his confinement in a place of safe custody.
A report of the case and its finds will be sent to the President for a decision.
