Man Found Guilty of Manslaughter
Jeffery Colata, a former National Basketball rep, who pleaded guilty to the charges, picked up a fight in front of Baristas Coffee house at Knolly Street in November 2006 with a group of drunken boys.
He punched a 27 year old Lepani Rokoduvunivosa who fell on a pavement and died two weeks after being on a life support machine.
Colata's lawyer Gavin O' Driscoll, in his submission told the court that Colata is 23 years old, is a first offender, was looking after his 3 week old daughter, has regretted his actions and is also willing to ask for forgiveness from the deceased family in the traditional way.
While sentencing Colata, Justice Nazhat Shameem said that she considers his mitigating factors and the fact that he looks after his daughter alone however he punched the deceased who was too drunk to defend himself and was on life support for two weeks and Colata is responsible for his action therefore he was sentenced to 2 years imprisonment.
