Lawyers Prepare for Fatiaki Case
It has been confirmed that the state wants Justice Fatiaki's case challenging the legality of the tribunal to be stayed until the high court makes a ruling on the case filed by ousted Prime Minister Laisenia Qarase challenging the legality or otherwise of the interim government.
The state's argument is that the Qarase case would resolve concerns on the legality of the appointment of the tribunal by President Ratu Josefa Iloilo.
The case will be called in the high court on June 13th. Meanwhile, this is a separate case from the action taken by Justice Fatiaki on his suspension and removal from office in January 2007.
Meanwhile, taxpayers have continued to pay suspended Chief Justice Daniel Fatiaki since January 2007, when he was suspended pending the inquiry. Justice Fatiaki is still staying at the Chief Justice's official residence while Justice Anthony Gates continues acting as the chief justice.
