State lawyers are now challenging the Fiji Court of Appeal's earlier ruling for a re-trial in Naitasiri High Chief Ratu Inoke Takiveikata's inciting mutiny case.

In the Supreme Court today, DPP lawyer Ashishna Prasad made submissions that Fiji Court of Appeal was wrong in quashing the conviction laid by the High Court.

Prasad told the Court that there were no good reasons given by the Court of Appeal in acquitting Ratu Inoke from the charges based on the grounds that there was insufficient evidence against him.

Justice Ronald Sackvile, Justice Kenneth Hendley and Justice Keith Mason will give their ruling on notice.

Ratu Inoke was represented by Akuila Naco. He was charged with 3 counts of inciting to mutiny in 2001 for allegedly inciting the November 2nd 2000 attempted mutiny at Queen Elizabeth Barracks and was sentenced to life imprisonment.

However, upon appeal the conviction was quashed and a re-trial was ordered.
