Lawyers representing ousted Prime Minister Laisenia Qarase and Interim Prime Minister Commodore Frank Bainimarama have not been able to come to an agreement on a list of witnesses to be called in the December 5th takeover case.
The layers were expected back in court at 2pm this afternoon to confirm that list of witnesses and other core issues surrounding the case.
Qarase's senior counsel Tevita Fa confirmed earlier that the main matter of contention is whether the President's Official Secretary Rupeni Nacewa can be called as a witness to give evidence.
Lawyers representing Commodore Bainimarama and others maintain that Nacewa was privy to confidential conversations and information relating directly to the actions of the President.
They argue that the President has reserved prerogative powers which he exercised on December 5th, 2006, and events and conversations leading to his decision is something that should not be brought before the courts.
The lawyers are still meeting and the case has been adjourned till 10am Tuesday.
