Lawyer faces misconduct charges
Serious allegations have been leveled against Shah which include his dealing in the sale of the Sun View Motel and Hostel Limited.
The charge sheet stated that in 2008 a Korean Couple purchased the property at a sum of $400,000 and Shah allegedly banked only $342,000 and only paid the complainant $7000 from the balance.
It is alleged that Shah was allegedly paid $25,000 in legal fees and $4000 for the hotel and liquor license transfer, when in fact there was no liquor license that existed within the motel.
In the same case, it is alleged that Shah was paid $35,000 in legal fees by the purchaser and another $10,000 by the seller.
Another complaint against Shah involves a client who wanted to purchase the Bollywood Nite Club in Nadi and $40,000 was paid into Shah's Trust Account in 2005.
However, Shah is alleged to have failed to prepare the Sales and Purchase Agreement but instead made a case against Bollywood Nite Club owner without the consent of his client and allegedly failed to cooperate with the complainant and failed to keep his client informed of the case progress.
Shah's case will now be called on February 3rd before the Independent Legal Services Commission to set a hearing date.
