Kumar’s Lawyer expected to make submission
When the case was called this morning, Lawyer Rajendra Chaudhry told High Court Judge Justice Daniel Gounder, that Kumar is charged with abuse of office by a public servant.
According to Chaudhry, he will make submissions to show that the position of a Mayor is not classified as a public office and the charge information should be quashed.
Judge Gounder questioned on whether the Penal Code defines who are public office holders and instructed that detailed submission be made on the issue. The case is adjourned to August 4th for mention.
Kumar has pleaded not guilty to charges of abuse of office after he had allegedly used Nasinu Town Council funds to purchase a personal vehicle.
Meanwhile, in a separate case, former Commissioner Central Inoke Devo is expected to take a plea on amended charges by FICAC.
FICAC lawyer Aca Rayawa told the court that they have amended the charge information. Judge Gounder has given Devo and his lawyer Apaitia Seru time to go over the information before a plea is taken on July 24th. Devo was earlier charged by FICAC for allegedly obtaining goods while holding a public office.
