Khan not under police custody
This was confirmed by State lawyer Sharvada Sharma who said that Police will continue with their random checks on Khan for sercurity reasons however they will not in any way interrogate him with regards to investigations against him.
This was revealed after consultations with Police where Sharma told the Court this afternoon that Police will not be able to be posted outside and around the Suva private premises as this would be an inconvenience to other patients.
However, Sharma reassured the Court that Khan would not be forcefully removed from the Suva Private Hospital.
Sharma had earlier today clarified that Khan was not under Police custody while admitted at the Suva Private Hospital.
However, in an interview with News Talk ZB Political Editor, Barry Soper, Khan told Soper that if he were not in police custody then he would have the freedom to meet whoever came to visit him adding that this is not the case.
The case has been adjourned to the 8th for hearing where they will determine whether Khan is in Police custody or not and whether his arrest was lawful.
Meanwhile, QC Peter Willams is seeking a Habaes Corpus which will also be decided on the 8th.
