Navy Commander Francis Kean will keep his position in the Navy and continue to receive his pay while his court appeal process is underway.

This has been confirmed by Military Spokesperson, Lt Colonel Mosese Tikoitoga.

Kean's lawyer, Haroon Ali Shah, on Tuesday filed an appeal against the 18 month sentence handed down by Judge Justice Gerrard Winter last Friday, after Kean pleaded guilty to one count of manslaughter.

Shah believes that his client should have been given a suspended sentence after showing a good record with the Navy.

Justice Winter had earlier said that a non-custodial sentence was not considered as maximum assault was used by Kean, who could have prevented the death of John Whippy on New Year's eve, had he controlled his temper.

The appeal will be heard today at 11.45am before Justice John Byrnes in chambers.
