An appeal by Navy Commander Francis Kean against the decision by Justice Gerard Winter not to disqualify himself from his murder case was called before a single Justice of Appeal this morning.

Kean's lawyer Abhay Singh made lengthy submissions in Justice John Byrne’s chambers on why Justice Winter should not preside over the case.

Soon after making his submissions behind closed doors, Singh refused to reveal any details outside the courthouse but confirmed that he will reveal the details when his client's case resumes in open court before Justice Winter this afternoon.

However, we have received confirmation that Justice Byrne has reserved his judgment for a later date.
