Judges Express Disappointment
When the case filed by ousted Prime Minister Laisenia Qarase and others against the Interim Government and the RFMF resumed this morning, Justice Gates stressed the counsels have failed to follow normal high court rules.
Judge Pathik highlighted the rules require the parties to conduct a pre-trial conference and provide to the court a list of agreed facts and the matters of contention which the Judges must deliberate on and hear arguments on.
Queens Counsel for the SDL Nye Perram then tried to justify this saying there are delays in filing certain documents and the Defendants have not clearly stated which Doctrines they will rely upon in their arguments.
Judge Gates did not entertain this and stressed the order issued yesterday which states the counsels have to file with the court a list of agreed issues for determination by the court, and a list of witnesses to be tendered, must be adhered to.
He said without both sides agreeing on which facts are true and also agreeing upon the exact orders the court has to make, the case cannot proceed. The case is adjourned till 2:30 this afternoon for the lawyers to comply with the order.
