High Court Judge Justice Lyone Seneviratne will rule on the compensation claim case of 59-year-old Jai Narayan who has alleged that a doctor at the CWM Hospital had administered him wrong medication and pronounced him dead in 2013.

While being cross-examined in court, the doctor said that the patient’s wife had shown her a packet of penicillin when she saw him on the 19th of March, 2013.

The female doctor confirmed that she had administered the penicillin based on her assumption that Narayan was not allergic to it. 

Narayan’s lawyer, Leena Goundar then asked the doctor if she had taken reasonable steps and care in this case.

The doctor said that she had not taken the steps.

When asked on what would a prudent and responsible doctor do in this case, the doctor said that she usually asks if the patient is allergic to penicillin but she did not do it that morning.

The doctor admitted that it was a mistake and it was overlooked.

She also said that she administered the penicillin and did not have the patient’s folder with her.

The doctor went on to say that the night shift is short-staffed and for some reason she could not retrieve the folder.

The lawyer representing CWM Hospital pointed out that Narayan’s wife had shown the packet of penicillin to the doctor.

The doctor also said that it would rule out that Narayan was allergic to the drug when the wife was showing her the medicine that he was taking.

Jai Narayan of 8 miles Narere says he is allergic to penicillin however he was given the shot by the doctor at CWM.

The man went to the hospital in the early hours of 19th of March, 2013 in an ambulance because he had a pain on his side.

They claim that the doctor did not ask for allergies before she administered him penicillin and two other drugs.

Narayan had a reaction after getting the shots.

He says that he then lost consciousness.

When he opened his eyes, he saw his family members crying.

Narayan alleges that he was pronounced dead by the doctor.

The lawyer representing CWM Hospital says that the doctor did not declare Jai Narayan dead.
