High Court Judge Justice, Daniel Gounder has ruled out an application made by the Director of Public Prosecutions Office that he should disqualify himself from handling the Sakiusa Rabaka case.

Justice Gounder in his ruling said that the Sakiusa Rabaka case will now go on re-trial from Monday and he will preside over the case.

The trial will continue with a panel of fresh assessors.

The nine accused, Patrick Nayaca-lagilagi, Taione Lua, Ulaiasi Radike, Epeli Nadura, Ratu Naisa Toutou, Joeli Lesavua, Jona Nareki, Ilaisa Kirimavua and Napolioni Naulia have been charged with allegedly murdering Sakiusa Rabaka on January 28th, 2007 in Votualevu.
