Jalal, Tuisolia case transferred to DPP’s Office
FICAC Lawyer Madhavwa Tennakoon told High Court Judge Priyantha Fernando that they have deferred the filing of disclosures and information of the consolidation of charges for Jalal and Tuisolia as they are transferring the matter to the DPP's Office.
FICAC had earlier asked for the matter to be transferred to the High Court so that FICAC could amalgamate the charges against Jalal with that of her husband, Sakiusa Tuisolia as they are facing similar charges.
Jalal is charged with seven counts of operating a restaurant without a license, failing to display a license, disobedience of lawful order and operating a food establishment without a license.
Judge Fernando then asked Tennakoon as to what powers did FICAC have to transfer the case to the DPP's Office.
Tennakoon informed the court that they are transferring the case under Section 55 (3) of the Criminal Procedure Code of 2009.
Defence Counsel Devinesh Sharma told the Court that this was a sensible thing to do and did not object to the application.
Judge Fernando also made variations to Jalal's bail conditions, and ordered that her passport be released to allow her to travel, with the exception that Former Judge Gwen Philips signs as an assurity that Jalal will go and return, and hand in her passport when the case is called again.
The case will be called again on March 4th.
