The Director of Public Prosecutions has concluded that there is insufficient evidence of any criminal wrongdoing by Suva resident, Josefa Bilitaki and that there will be no further action.
DPP has also concluded that there is also insufficient evidence to proceed to court in relation to the complaint of the alleged assault filed by Bilitaki.
According to the Office of Director of Public Prosecutions Bilitaki was arrested by a task team on September 26th for allegedly sending indecent and annoying messages through his telephone to the Prime Minister.
Bilitaki was detained at Totogo Police Station and he fell ill the next day and was taken to the CWM Hospital where he received medical treatment for high blood pressure.
Police had sent the file to the Director of Public Prosecutions to review the evidence and make a decision on whether any charges should be laid.
DPP Christopher Pryde said on 7th October Police received a formal complaint by Bilitaki that he was assaulted by some men he took to be military or police officers and that he was unlawfully detained by Police in September.
The file was again sent to DPP for review.
Pryde say he has reviewed all evidence and concludes that there is insufficient evidence.
The Director of Public Prosecutions has also raised concern by the way in which Bilitaki was arrested and held in custody for a trivial matter.
Pryde said the procedure for arrest without warrant of suspected person is clearly set out in the Criminal Procedure Decree.
He added that he intends to raise the issue of arrest without a warrant with the Police Commissioner.
