Injunction sought to stop Momi auction
Lawyer representing Matapo Limited, one of the developers of the site, Kafoa Muaror, filed the injunction motion before Judge Justice William Callancini in chambers yesterday.
The injunction motion is to stop FNPF from trying to go ahead with the sale of the property until such time the case is dealt with.
FNPF lawyer Adish Narayan also made submissions that plans and site maps of the Momi project in the possession of Matapo Limited be handed to the FNPF as any prospecting developer will need these documents.
The case will now be called on August 21st in the Labasa High Court.
Narayan said the auction is scheduled for August 25th and Judge Callancini will be based in the Labasa High Court for the next three weeks and so they will have to travel north for the case to be heard.
The Fiji National Provident Fund took possession of the Momi site and announced it will be auctioned to the highest bidder in efforts to recover the over $80million investment in the project.
It was announced earlier that investors from around the world are interested in purchasing the resort project and several investors have brought teams down to carry out the due diligence process over the last few weeks.
