The High Court judge rejected a 41-year-old man's appeal against the Magistrates Court's decision to sentence him to 12 months imprisonment after he was found guilty of indecent practice.

Robyn Agnu was sentenced to 12 months jail on the 3rd of April this year for indecent practice with a nine-year-old boy at his place in Suva.

Agnu appealed against the Magistrates Court’s decision claiming that the Magistrate failed to evaluate the evidence given by prosecution and defense, that she was biased in her approach in analyzing the evidence, and acted on conjectures in convicting him.

However, High Court judge Justice Nazhat Shameem dismissed the appeal saying that she doesn't think after seeing the court records and the judgement, that the Magistrate in any way reversed the burden of proof, thus Agnu will now serve his sentence.
