ILSC Connors to hear Khans case
This was revealed this morning, as Connors dismissed an application by Khan for Connors to disqualify himself from hearing the matter on the basis of alleged bias towards him.
The ruling stated that the allegation of bias is that Khan commenced an action in 2005 in the High Court against Connors and also in separate proceedings against his wife, however Khan discontinued both cases and apologised for commencing them.
Also to support his application, Khan said that a decision by Connors while he was a Judge of the High Court was overturned by the Fiji Court of Appeal adding this decision was in part the substance of proceedings against Connors by Khan, although Khan said it was not uncommon for decisions of a judge at first instance to be overturned on appeal.
Upon looking at these facts, Connors ruled that one would be unable to conclude that the reasonable and informed observer would consider there was a real danger of bias of alternatively apprehend or suspect bias.
Before this decision, Khan's professional misconduct case was set for a five day hearing beginning on May 3rd, this year.
