High Court Dismisses Silatolu Case
Silatolu has complained that he was not treated with dignity and respect relating to a Family Day organized by him under the Yellow Ribbon Program scheduled to take place on October 5th last year however was cancelled.
In his case Silatolu stated that the Family Day was approved by the Prisons Commissioner but cancelled by the Chief Officer including visitation by family members on that day.
However, the State lawyer Kunal Singh argued that the application should be struck out on two grounds as it disclosed no reasonable cause of action and it was an abuse of process of the court.
Singh also told Judge Justice Thomas Hickie that having a Family Day was not a right under the Constitution but a mere privilege which can be withdrawn anytime.
Justice Hickie while dismissing the case stated that Silatolu can lodge a formal complaint with the Fiji Human Rights Commission if he wishes to as the state has argued that the issue of a family day is not a right but a privilege granted within the prison system.
