A hearing date will be determined this Friday by the Independent Legal Services Commissioner in relation to the case of Suva lawyer William Wylie Clark.

Clark who is charged with 6 counts of Professional Misconduct and Unsatisfactory Professional Conduct appeared before Commissioner John Connors for mention this morning.

On the first count, Clark being the trustee for Jamnadas Clark & Associates Trust Accounts is alleged to have failed to keep proper accounting and other records of all trust money received for the two trust accounts at ANZ and Westpac Banks during the period of 5th September to 30th September 2001 in order to sufficiently explain the actual balance of $7,588.01, in light of the fact that the combined trial balance calculated for both Trust Accounts indicated that the funds ought to have totaled approximately $524,778.88.

On the second count, it is alleged that Clark during the period from the 1st October 2000 and 30th September 2001, being a co-signatory of the same Trust Accounts failed to keep such accounting and other records of all trust money received by him in order to explain the actual balance of $7,588.01, in light of the fact that the combined trial balance calculated for both the Trust Accounts indicated that the funds ought to have totaled approximately $524,778.88.

On the third count, Clark is alleged to have failed to disclose at all times the true position regarding all trust money held in both Trust Accounts and the application of trust money received during the period from 5th September 2001 and the 30th September 2001.

It is also alleged that Clark failed to ensure that both Trust Accounts were maintained in a way that enabled the accounting records to be conveniently and properly audited, in that they were not reconciled on a monthly basis.

The case has been adjourned to this Friday.
