The twenty seven year old man charged with two counts of rape was this morning acquitted of one count of rape by the Suva High Court.

High Court Judge Justice Priyantha Fernando agreed with the decision by the assessors made on Monday and acquitted Kaliova Baleimaira of the first count where it was alleged that he on the 27th of November in 2007 in Pacific Harbour in Navua raped the victim.

However Justice Fernando found him guilty as convicted on the second count, which is also rape.

The Suva High Court heard that on the same date, Baleimaira after the first count had further carnal knowledge with the victim without her consent.

Baleimaira was earlier acquitted of the third count where it was alleged that he stole a watch valued at $300 from the victim.

Baleimara has been remanded in custody and is expected to be sentenced on the 22nd of this month.
