The plea for former FNPF Executives Olota Rokovunisea and Foana Nemani was deferred this morning after their Lawyer Graham Leung again submitted that the Fiji Independent Commission Against Corruption was an illegal body.

When the case was called this morning, Leung told Magistrate Aminiasi Katonivualiku that although the Qarase ruling by the High Court is binding of the Magistrates Court, an appeal on the ruling was pending and that Magistrate Katonivualiku should not make a judgment on the matter.

FICAC lawyer Paul Madigan strongly objected and stressed that even though there was an appeal in court, he humbly requested that the court follow the rule of law and continue with the case.

Magistrate Katonivualiku then adjourned the case till January 28th next year and stated that he would leave the decision of the court proceedings to the Magistrate who would preside on the matter next year.

Meanwhile, the case against former Fijian Holdings CEO Sitiveni Weleilakeba has been adjourned till December 15th as his lawyer is out of the country and would like to speak to FICAC regarding the charges against his client.
