The appeal case for a suspended jail sentence of a former fisheries clerk was heard in the Labasa Magistrates Court today.

Magistrate Anare Tuilevuka sentenced Savenaca Labavuka last year in December to 18 months imprisonment after he pleaded guilty to 6 counts of larceny by servant.

Labavuka had falsified receipts and taken money amounting to $3000 from a government fisheries cooperative account between May and July in 2005.

Defence lawyer Amrit Asen in his submission today argued that his client should be showed mercy by the court and have his sentence suspended.

However, FICAC prosecutor Paul Madigan in response argued that the offences were serious breaches of trust and that since the conviction, a single cent has not been paid to Wainikoro Fisheries Cooperative.

Justice Daniel Gounder will decide on the appeal at 2pm tomorrow.
