FICTU seeks stay on ER promulgation
The case was called before Judge Justice Jocelyn Scutt inm chambers today and after a two hour hearing, Lawyer representing the President and the state, Adish Narayan confirmed that they want the matter stayed until ousted Prime Minister Laisenia Qarase's case is dealt with.
However, representing the unions under FICTU, Lawyer Savenaca Banuve said they opposed the stay application on the grounds that there is no guarantee that a ruling will be delivered in the Qarase case before April 4th,2008 when the Employment Relations promulgations would come into effect.
Banuve said they also submitted that if a stay is to be granted on the proceedings until the conclusion of the Qarase case, then the stay should also apply to the implementation of the ER promulgation until such time.
Judge Scutt will deliver her ruling on the strike out and stay application on notice.
