A dive resort operator has been ordered to pay over $130,000 to the Credit Corporation of Fiji by the Lautoka High Court.

Ratu Kini's Dive Resort in the West had entered into an Asset Purchase Agreement with Credit Corp for purchase of 8 vehicles for the company.

However, unable to make the payments on the assets, Credit Corp repossessed three vehicles and sold it off by tender.

One of the Co-directors of Kini's Dive Resort claimed that the Asset Purchase Agreement was unenforceable and that Credit Corp repossessed the vehicles unreasonably.

Lautoka High Court Judge Justice Sosefo Inoke ruled that he found no evidence to suggest that Credit Corp sold the vehicles at undervalua, as also claimed by the defendant.

Inoke ruled that Ratu Kini's Dive resort has to pay Credit Corp $91,200 being the balance of the Asset Purchase Agreement, $34,200 in interest under the agreements and an additional $5000 within 28 days as court costs.
