A decision made by the Fiji Islands Revenue and Customs Authority's Appeals Board to hold an employee’s promotion last year has been upheld by the Lautoka High Court.

A customs officer of Nadi, Losalini Daulali, applied for a judicial review against the decision of FIRCA's Appeals Board seeking for an order to quash the decision by the board.

The court heard that FIRCA advertised for 14 senior customs officer positions in 2005 for which Daulali applied and was promoted to one of these positions in January 2006.

However, another employee challenged her appointment by appealing to the Appeals Board.

Judge Justice Sosefo Inoke was told that following a hearing from all the parties, FIRCA's Appeals Board allowed the appeal and set aside Daulali's promotion in February last year after which Daulali filed an application for judicial review.

Judge Inoke decided that Daulali's employment rights have been dealt with by the respective authorities and that the application filed by Daulali fails and with it the application for leave for judicial review.
