Court to rule on FICAC in March
Judge Justice Nazhat Shameem today told Suva lawyer Rajendra Chaudhry and FICAC lawyer Paul Madigan that her ruling on 20th March will confirm if the promulgation of FICAC is legal.
Rajendra Chaudhry who is the lawyer of former Nasinu Mayor Rajeshwar Kumar and former Nasinu Town Council chief executive officer Jaswant Kumar raised a point in court that FICAC was formed on the advice from the interim government to the president.
Chaudhry said that the president should not have acted on the advice of Interim Prime Minister Commodore Frank Bainimarama.
He also stressed that the formation of FICAC is not legal and thus it cannot charge people.
FICAC lawyer Paul Madigan said that in this kind of situation, the president had to consult the executive authorities concerned which was the interim government.
He also said that there is no evidence in the court that FICAC was promulgated in bad faith.
Rajeshwar Kumar and Jaswant Kumar who have been charged with abuse of office will take their plea after the ruling.
