Court refuses Abhay Singh application
Last week, the Chief Registrar refused to issue Singh with a practicing certificate based on Singh's earlier conviction by the courts on a charge of trying to pervert the course of Justice.
Civil High court Judge Justice Pradeep Hettiarachchi while delivering the ruling on behalf of Justice Angala Wati states, that he has fully considered the application and has come to the conclusion that Singh has totally misconstrued the proper procedure which he should follow to challenge the refusal of the Chief Registrar to issue a Practicing Certificate.
Justice Hettiarachchi stresses that the Court of Appeals stay ordered issued in relation to Singh appeal against his conviction, has no bearing on the Chiefn Registrar's prerogative to issue a Practicing Certificate as the stay ordered was in respect of Singh being struck off the rolls.
The Judge said even if Singh is reinstated to the rolls, Singh still has to apply for a practicing certificate and the Court of Appeal has made no coercive orders in respect of this.
He said on these brief reasons, the application is denied.
Justice Hettiarachchi also states that due to time constraints he is unable to produce a detailed written judgement which would be given at a later date.
