Companies will now be held accountable for the actions of their employees under the new Crimes Decree.
Those are the words of Former High Court Judge Nazhaat Shameem.
Speaking at the Corporate Governance Workshop Shameem said before the Crimes Decree came into effect, corporate bodies were not liable under the Penal Code for offences committed by their employees.
However, Shameem said under section 51 of the Crimes Decree, corporate bodies face the brunt of the law in the same way it applies to individuals.
Section 52 of the Crimes Decree stated that if a physical element of an offence is committed by an employee, agent or officer of a body corporate acting within the actual or apparent scope of his or her employment, or within his or her actual or apparent authority, the physical element must also be attributed to the body corporate.
