The sentencing of a civil servant who had pleaded guilty to six charges of Larceny By Servant on Monday was today put on hold as the Magistrate did not want to make a ruling just yet because FICAC's legality was still unknown.

The FICAC case against Savenaca Labavuka was called today at the Labasa Magistrate's court before Magistrate Tuilevuka for sentencing however Tuilevuka said that he was cautious not to make a ruling today stating that he had read in the media that there was a challenge in the high court on the legality of FICAC.

FICAC representative Paul Madigan said the case should still go ahead as the Qarase judgment was binding of the Magistrate's court however Magistrate Tuilevuka called for written submissions on the 5th of December and adjourned the matter to December 11th.

The court heard that between January to July 2005, Labavuka had misused over $3,000 from Wainikoro Fisheries Co-operative Fishing Outlet's Impress Account.
